Terms of Service

1. Agreement

By accessing DPalette, signing in, publishing a workflow, or purchasing a plan, you agree to these Terms. If you use DPalette for an organization or Discord server, you represent that you have authority to do so.

2. Service

DPalette provides a visual Discord Bot Builder, workflow runtime, interactions, a guild-scoped database, webhooks, schedules, integrations, and related tools. Features may be added, changed, limited, or discontinued as the service evolves.

3. Eligibility

You must meet Discord's minimum-age requirements and be legally capable of agreeing to these Terms. If applicable law requires parental or organizational consent, you must obtain it before use.

4. Account and security

Authentication uses Discord. You are responsible for maintaining control of your Discord account, protecting credentials and Guild Secrets, and promptly reporting suspected unauthorized access.

5. Authority over Discord servers

You may configure or publish workflows for a Discord server only when you are authorized to manage that server. DPalette may check Discord permissions but cannot determine every internal rule or legal authority applicable to your community.

6. Acceptable use

Do not use DPalette to violate law or third-party rights; harass, threaten, defraud, spam, phish, distribute malware, evade platform controls, perform unauthorized surveillance or access, overload Discord or DPalette, bypass quotas or security limits, or automate conduct prohibited by Discord's terms or policies.

7. Your workflows and content

You retain rights you have in workflow definitions, templates, database records, and other content you submit. You grant the DPalette operator the limited rights necessary to host, process, transmit, back up, and execute that content to provide and secure DPalette. You are responsible for ensuring you have rights and lawful grounds to process data through your workflows.

8. Third-party services

DPalette depends on services such as Discord, Stripe, hosting/database providers, and APIs chosen by you. Their terms, outages, rate limits, API changes, or enforcement decisions may affect DPalette. We do not control third-party services.

9. YouTube features

DPalette's YouTube features use YouTube API Services. By using these features, you also agree to be bound by the YouTube Terms of Service linked below. You may monitor only public channels and content that you are authorized to use, and you must not misuse YouTube data or circumvent YouTube or DPalette limits. DPalette begins revalidating canonical channel IDs resolved from @handles after 27 days. If an ID cannot be revalidated by day 28 or the handle resolves to a different channel, DPalette expires the API-derived ID and subscription and pauses the monitor. Republish a fixed bot behavior or run Add YouTube Monitoring again for a dynamic monitor to resume. YouTube API-derived event and item operational data expires after 28 days and is scheduled for deletion before YouTube's 30-day policy limit. YouTube's availability, API quotas, policy changes, and enforcement may affect these features.

10. Text-to-speech

Explicitly configure the text source and destination voice channel, and inform affected participants about speech. Do not broadcast private text to people without access or bypass permission checks. Speech has monthly character, connection and queue limits and may be unavailable when limits are reached or service setup is incomplete. It cannot be used to record calls.

11. Plans and quotas

Free and paid plans include the limits shown in DPalette. Production executions include event, manual, slash-command, webhook, schedule, and Interaction-triggered runs. Tests, previews, and dry runs may be treated differently as shown in the product. Safety ceilings remain enforceable on all plans.

12. Paid subscriptions

DPalette Plus is currently offered at US$5 per month per Discord server unless a different price is clearly shown before purchase. Subscriptions are processed by Stripe and renew automatically until canceled. You can manage or cancel through the billing portal when available. Taxes, refunds, cancellation rights, and mandatory consumer protections are governed by applicable law and the checkout terms presented to you.

13. Fair use and limits

You must not circumvent plan, rate, concurrency, storage, or execution limits. We may throttle or block activity that threatens reliability, security, other users, Discord, or service providers, even where a numerical quota has not yet been reached.

14. Changes to features and pricing

We may modify features, quotas, or prices. Price changes to an existing paid subscription will be communicated as required by applicable law and will not be applied retroactively to an already-paid billing period.

15. Availability

DPalette is provided on a reasonable-efforts basis and does not include a guaranteed service-level agreement unless separately agreed in writing. Maintenance, outages, Discord/API changes, security incidents, or force-majeure events may interrupt service.

16. Suspension

We may suspend workflows, servers, or accounts when reasonably necessary to investigate abuse, security threats, non-payment, legal requirements, or material violations of these Terms. Where appropriate, we will try to provide notice.

17. Termination and data

You may stop using DPalette at any time and cancel paid subscriptions through the available billing tools. After termination or deletion, data may be removed after a reasonable retention period, subject to backups and records we must retain for legal, security, accounting, or dispute purposes.

18. Disclaimers

DPalette helps automate Discord actions, but you remain responsible for reviewing workflows before publishing them and for the effects of your automation. Preview and validation reduce risk but do not guarantee a workflow is correct, lawful, safe, or suitable for your server.

19. Limitation of liability

To the maximum extent permitted by applicable law, the DPalette operator is not liable for indirect, incidental, special, consequential, or punitive losses, or for loss caused by third-party services, user workflows, unauthorized configuration, or events outside reasonable control. Nothing in these Terms excludes liability that cannot legally be excluded or limited, including mandatory consumer protections.

20. Governing law and disputes

These Terms are governed by the laws applicable where the operator is established, to the extent legally permitted. Disputes are subject to the competent court under applicable law, except where mandatory consumer or other law gives you a different forum or rights.
